Bennett S. Schwartz

Bennett S. Schwartz is a partner in the law firm of Troff, Petzke & Ammeson.  Mr. Schwartz, received a Bachelor of Arts Degree from Michigan State University, with honors, in 1980, and a law degree from Wayne State University Law School in 1983.  Mr. Schwartz has practiced in the Berrien, Cass and Van Buren County Circuit Courts and has argued numerous cases in the Michigan Court of Appeals.  He is involved in several professional organizations including being a member of the State Bar of Michigan Real Property and Environmental Law Sections and as co-chair of the Zoning and Land Use Special Committee of the Real Property Section.  He is admitted to the State Bar of Michigan, the United States Federal District Court and is a member of both the American Bar Association and Berrien County Bar Association.

 

Practice Areas

Real Estate, Land Use & Development

Mr. Schwartz focuses his practice primarily in the areas of real estate, including development and complex land use issues; residential real estate transactions; environmental law; and zoning issues.  Mr. Schwartz has lectured on the subjects of residential real estate transactions and environmental law.  He has represented developers and property owners with respect to a variety of matters including site condominiums; subdivisions; land division problems and golf course development.  He also practices extensively in the area of vacation home real estate transactions, with emphasis in assisting second home buyers with due diligence issues including critical dune, high risk erosion and zoning compliance matters. In addition, Mr. Schwartz's practice emphasizes the representation of numerous condominium associations and local municipalities.  His representation of municipalities involves all aspects of advising and representing them with respect to municipal affairs, particularly in the areas of ordinance interpretation and enforcement.  He also serves in a prosecutorial capacity with respect to the enforcement of municipal code violations.
